Winter Parking Regulations and Snow Removal
6.05(5) WINTER PARKING
(a) For a period of forty-eight (48) hours immediately following an accumulated snowfall of two inches (2”) or more, as measured at the Waupun
Safety Building, no person shall park any vehicle on any street or alley in the City of Waupun between the hours of 2:00 a.m. and 6:00 a.m.
(b) The restrictions set forth in subsection (a) above shall not apply to Physicians or Emergency Medical Technicians on emergency calls.
(c) For a period of twenty-four (24) hours immediately following an accumulated snowfall of two inches (2”) or more, as measured at the Waupun
Safety Building, no person shall park any vehicle in any City parking lot between the hours of 2:00 a.m. and 6:00 a.m., except the following
areas designated as “Overnight Off-Street Parking Areas”:
1. The northerly 20 feet of that parking area lying north of 300-312 E Main St., being part of the south half of Lot 4 Block 15 of the Plat of East
Waupun to the City.
2. The southerly 60 feet of the east 20 feet of that parking area lying north of 416 E Main St., being part of Lot 1 Block 14 of the Plat of East
Waupun to the City.
3. The southerly parking area lying south of the east-west alley running through the 400 block of E. Main St. between Carrington St. and
S. Madison St. being a part of the north half of Lot 7, Block 11 of the Plat of East Waupun to the City and being 56 feet in depth and
61 feet in width.
4. The northeast tier and southern tier of parking stalls in the municipal parking lot bordered by S. Mill St. and S. Madison St.
(d) With regard to each of the winter time, overnight, off-street parking areas listed in paragraph (c) above, the following parking limitations
shall apply:
1. No vehicle shall remain in any such parking space for longer than a twelve (12) hour period.
2. No person shall park any vehicle in any parking space between the hours of 8:00 a.m. and 11:00 a.m. for a period of twenty-four (24)
hours immediately following an accumulated snowfall of two inches (2”) or more, as measured at the Waupun Safety Building.
(e) The Director of Public Works or, in his absence, any member of the Police Department, may authorize immediate and summary removal of
any vehicle parked in violation of these sections and the costs of removal and subsequent storage shall be paid by the owner of the vehicle
removed before the vehicle is restored and released to the owner.
7.10 - SNOW EMERGENCY.
- MAYOR MAY DECLARE. The Mayor or, in his absence, the Council President, after consultation with the Director of Public Works, the Fire Chief and the Chief of the Police Department may declare that a snow emergency exists in the City. Such emergency shall exist until terminated by the Mayor, except that the City Council may at any regular or special meeting terminating such emergency.
- NOTICE TO PUBLIC. The declaration of such an emergency shall immediately be noticed to the public through all local media and become effective 6 hours after the release of such declaration to the media.
- PROHIBITED PARKING. Upon declaration of a snow emergency, parking will be prohibited at all times on the south side, east side and southeast side of all streets in the City, excepting for the following portions of streets which shall be excluded from such restrictions:
(a) Main St. from Commercial St. to Carrington St.
(b) Madison St. from Franklin St. to Olmstead St.
(c) Fond du Lac St. from Franklin St. to Main St.
(d) Carrington St. from Main St. to Brown St.
(e) That portion of any street where parking is already limited to only one side.
- VIOLATIONS.
(a) The owners of vehicles parked in violation of this section shall be subject to penalties and forfeitures as set forth in §6.11 of this Municipal Code.
(b) Any vehicle parked in violation of this section shall be declared a nuisance obstructing a street or rendering the passage upon such street dangerous for the safe passage of vehicles, ambulance service and fire protection and, therefore, the vehicle may be summarily removed by the City. The Chief of Police or the Superintendent of the Street Department shall authorize such removal. The City may contract for the removal of vehicles parked in violation of this section. The owner of any vehicle removed under this section shall be responsible for the costs of such removal and the storage of the vehicle and shall pay such costs before the vehicle is released to the owner.
- PARTIAL LIFTING OF EMERGENCY. The Mayor may lift the restricted parking limitation imposed by this section from some streets after the snow has been removed from both sides of such streets while permitting the restricted parking limitations to remain in force upon streets from which the snow has not been removed. Notification of any streets from which the restricted parking limits have been removed shall be made to all local news media.
- SNOW REMOVAL. In order to assist in the removal of snow from the south, east and southeast sides of City streets, the Director of Public Works or such person as he may designate may direct that the restriction parking limitation shall temporarily apply to the north, west or northwest sides of streets from which the snow is to be removed. Signs indicating a reversal of the restricted parking regulations shall be posted on the street from which snow is to be removed at least 6 hours before the snow removal is to begin.
7.07 - SNOW AND ICE REMOVAL. (Rep. & recr. #09-03)
- REMOVAL OF SNOW REQUIRED. The owner or lessee of every lot or parcel of land in the City fronting or abutting upon a sidewalk shall clear the sidewalk, in front of or abutting upon such premises, 24 hours after the end of the snow event, and shall cause the same to be kept clear of snow and ice. If the owner or lessee has no adjacent yard or parkway for the depositing of snow, snow may be placed on the portion of sidewalk nearest the curb so as to allow for safe pedestrian traffic on as much of the sidewalk as is practical.
- PROPER DEPOSITING OF SNOW. No person shall deposit, or cause to be deposited, any snow or ice taken and removed from his premises or elsewhere upon any sidewalk, alley, parkway, public place or street in the City, provided, however, that snow removed from a sidewalk in front of or abutting his premises, as is required by subsection (1) above, may be deposited on the adjacent parkway. Snow shall not be piled at or near street intersections or parking lot exits so as to obstruct the view of pedestrians or operators of motor vehicles.
- RESTRICTIONS.
(a) The deposit of any snow or ice on any sidewalk, alley or street of the City contrary to the provisions of this chapter is declared to be a public
nuisance.
(b) In addition to the penalty provided for violation of this section, the City may summarily remove such snow or ice and cause the cost of such
removal to be charged to the owner of the property from which it has been removed, as set forth below.
(c) The cost of snow and/or ice removal shall be charged to the property owner at the rate charged by the City's contractor, together with an
administrative fee of $100.00 per occasion. These costs are not to be considered a penalty, but are to reimburse the City for its cost in
administration and overhead.
